This page has four parts: our Privacy Policy, our Video Surveillance Policy, our General Facility Policies, and our External Social Media Guidelines. Together they explain how MQ Iron, LLC, doing business as Q Fitness (“Q Fitness,” “we,” “us,” or “our”), handles your information and runs the facility. See also our Terms of Use and membership agreement, which this policy doesn't replace.

Part I — Privacy Policy

1. Scope

This Privacy Policy explains how Q Fitness collects, uses, discloses, and protects personal information. It applies when you:

  • visit qfitnessfl.com or another website that links to this policy (the “Site”);
  • contact us, submit a form, request information, or share a testimonial;
  • register for or manage a membership;
  • book or receive personal training, group training, or another service;
  • visit or access the Q Fitness facility; or
  • otherwise communicate or interact with Q Fitness.

This policy does not apply to a third party's website, platform, or service. Third parties have their own privacy practices, which we encourage you to review.

2. Personal Information We Collect

The information we collect depends on how you interact with us and may include the following categories.

A. Contact and identity information

We may collect your name, postal address, email address, telephone number, date of birth, emergency-contact information, and other identifiers you provide.

B. Membership and transaction information

We may collect information about your membership type, start and cancellation dates, facility access, appointments, classes, purchases, invoices, payment status, and communications about your account.

Membership registration and payments are handled through Gymdesk, our third-party membership-management provider (see “How Gym Desk uses your information” in the membership agreement for detail on that provider specifically). A payment processor may collect card or bank-account information directly. Q Fitness may receive limited payment information, such as the payment method, billing address, transaction amount, status, and the last digits of an account or card, rather than complete payment credentials.

C. Fitness and training information

If you participate in training or voluntarily provide the information, we may collect fitness goals, training history, exercise preferences, measurements, physical limitations, injury information, or other health-related information needed to tailor or safely provide a requested service — including your baseline assessment results.

Q Fitness is generally not a healthcare provider or health plan subject to the Health Insurance Portability and Accountability Act (“HIPAA”). Information you provide to Q Fitness may therefore not be protected by HIPAA, although we will handle it as described in this policy and applicable law. Do not send sensitive medical information through a general website form.

D. Facility access and security information

Members unlock the door using the Rhombus app on their phone. We collect the access records Rhombus generates — check-in and entry logs, visit dates and times — along with incident reports and video-surveillance footage (see Part II). We use this information to manage facility access, support member safety, protect people and property, investigate incidents, and enforce agreements and policies.

We do not collect fingerprint or other biometric identifiers unless we give you a separate legally required notice and obtain any legally required consent before collection.

E. Communications and submissions

We collect information contained in emails, texts, calls, contact forms, requests, feedback, photographs, testimonials, success stories, and other communications or content you submit. Please do not include information about another person unless you are authorized to provide it.

F. Internet, device, and usage information

The Site is a set of static pages with no server-side application behind it, so this category is limited: your browser and our host (Vercel) exchange only what's required to serve the page — your IP address and standard request information appear in infrastructure-level logs used for security and reliability, not for tracking you individually. See Section 7 for what the Site itself does and doesn't collect.

3. Sources of Personal Information

We may collect personal information:

  • directly from you;
  • from facility systems (Rhombus access records, video surveillance) and Q Fitness personnel;
  • from a parent, guardian, family-member account holder, or person purchasing services for you;
  • from Gymdesk and other service providers we use for membership management, payment, scheduling, and communications; and
  • from publicly available sources or social-media platforms when you interact with Q Fitness there.

4. How We Use Personal Information

We may use personal information to:

  • respond to questions and requests;
  • establish, administer, bill, and support memberships and accounts;
  • schedule and provide personal training, group training, and other services;
  • authenticate members, control facility access via Rhombus, and maintain security;
  • communicate about appointments, transactions, memberships, safety, and policy changes;
  • send marketing communications where permitted by law and consistent with your choices;
  • personalize and improve the facility, equipment, programs, and services;
  • review testimonials, feedback, and member experiences;
  • prevent fraud, misuse, security incidents, and unlawful activity;
  • investigate injuries, complaints, accidents, or policy violations;
  • protect the rights, safety, and property of members, guests, staff, Q Fitness, and others;
  • comply with legal obligations and enforce our agreements; and
  • complete a merger, financing, acquisition, reorganization, sale, or other business transaction.

5. How We Disclose Personal Information

We may disclose personal information to the following recipients for the purposes described in this policy:

A. Service providers

We disclose information to Gymdesk (membership management and payments) and Rhombus (facility access and security), and may disclose it to other companies that provide website hosting, communications, professional advice, maintenance, or similar services on our behalf. These providers may use the information to perform services for Q Fitness and as otherwise permitted by their agreements and applicable law.

B. Third-party platforms you choose to use

If you select a link or use an integrated third-party service — such as the Gymdesk portal, the Rhombus app, a map, an embedded video, or a social-media platform — the third party may collect information directly from you. Its privacy policy governs its processing.

C. Legal, safety, and compliance recipients

We may disclose information to courts, regulators, law-enforcement agencies, government authorities, insurers, attorneys, auditors, or other parties when we believe disclosure is reasonably necessary to comply with law or legal process; investigate or prevent fraud, security incidents, or illegal activity; enforce an agreement; or protect rights, safety, and property.

D. Business-transaction recipients

We may disclose or transfer information in connection with an actual or proposed merger, acquisition, financing, bankruptcy, reorganization, sale of assets, or similar transaction, subject to applicable legal requirements.

E. At your direction or with your consent

We may disclose information when you direct us to do so or give consent, including when you authorize publication of a testimonial, photograph, or success story.

6. Sale, Sharing, and Targeted Advertising

Q Fitness does not sell personal information for money, and does not “share” personal information for cross-context behavioral advertising or process it for targeted advertising as those terms are defined by applicable U.S. state privacy laws.

If Q Fitness later engages in an activity treated as a sale, sharing, or targeted advertising under applicable law, we will update this policy and provide any required opt-out method.

7. Cookies and Analytics

The Site is built as static pages with no analytics, advertising, or tracking scripts of any kind — we don't run Google Analytics, an ad pixel, or a cookie-consent banner, because there's nothing on this Site that sets a cookie. If that changes — for example, if we add an analytics tool or an embedded booking widget that sets its own cookies — we'll update this section first, describe what was added and why, and provide any consent or opt-out required by law.

Some browsers offer a Global Privacy Control (“GPC”) or similar opt-out signal. Where legally required and technically supported, we will process recognized signals as requests to opt out for the browser or device that sends the signal, once the Site has anything for that signal to apply to.

8. Communications and Marketing Choices

You may unsubscribe from marketing emails by using the unsubscribe link in the message. You may opt out of marketing texts by replying STOP. Message and data rates may apply. We may continue sending non-marketing communications, including responses to requests and messages about memberships, appointments, transactions, safety, or legal matters.

To update other communication preferences, contact us using Section 15.

9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including to provide services, administer memberships, maintain business and tax records, resolve disputes, protect safety and security, enforce agreements, and comply with law. Retention periods vary based on the type and sensitivity of information, the reason it was collected, and legal requirements.

Our video-surveillance retention period (Part II) is still being confirmed with Mike before it goes up here — ask us if you'd like to know it ahead of that.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No storage or transmission system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of account credentials and the Rhombus app on your phone, and should notify us promptly if you believe an account or access credential has been compromised.

11. Children's Privacy

The Site is not directed to children under 13, and Q Fitness does not knowingly collect personal information online directly from a child under 13 without legally required parental consent. Memberships or services involving minors must be arranged by or with the involvement of a parent or legal guardian as required by the applicable membership agreement, Q Fitness policy, and law.

If you believe a child under 13 submitted personal information to us without appropriate consent, contact us using Section 15. We will review the request and delete the information where required by law.

12. Your Privacy Rights

Depending on where you live and subject to exceptions, applicable law may allow you to request that we:

  • confirm whether we process your personal information;
  • provide access to or a copy of certain personal information;
  • correct inaccurate personal information;
  • delete certain personal information;
  • provide certain information in a portable format;
  • identify categories of information, sources, purposes, and recipients; or
  • limit certain uses of sensitive personal information.

You may also have the right to appeal our response and to use an authorized agent. We will not unlawfully discriminate against you for exercising a privacy right.

To submit a request, contact us using Section 15 and clearly describe the right you wish to exercise. We may need to verify your identity and authority before completing the request. We will use information submitted with a request only to verify and respond to it. If an authorized agent submits a request, we may require proof of authorization and may ask you to verify your identity directly.

These rights are not absolute. We may retain or decline to disclose information where permitted or required by law, such as to complete a transaction, maintain security, comply with recordkeeping duties, protect legal rights, or preserve another person's privacy.

13. Third-Party Links and Services

The Site may link to third-party services, including Gymdesk, Rhombus, mapping services, embedded videos, and social-media platforms. Q Fitness does not control those parties' privacy or security practices. Review their policies before providing information.

14. Changes to This Privacy Policy

We may update this policy periodically. We will post the revised version and change the “Last updated” date. If a change is material, we will provide additional notice where required by law. The revised policy applies from its stated effective date.

Part II — Video Surveillance Policy

1. Purpose and scope

Q Fitness uses video-surveillance systems at its facility to support safety, control access, protect people and property, investigate incidents, and enforce memberships and facility policies. Cameras may operate continuously, but recordings are not necessarily watched in real time. The existence of surveillance does not guarantee that every area, event, or incident will be observed or recorded.

2. Camera placement

Q Fitness places cameras in areas where surveillance serves a legitimate safety or security purpose. Cameras will not be knowingly installed in restrooms, changing areas, or other locations where a person has a reasonable expectation of privacy.

3. Notice

Q Fitness may post notices at facility entrances or in monitored areas. Questions about surveillance may be directed to the contact listed in Part I, Section 15.

4. Access and disclosure

Access to surveillance systems and recordings is limited to authorized personnel and service providers with a business need. Q Fitness may review or disclose footage to investigate an incident, respond to a member request when appropriate, protect safety or property, handle an insurance claim, comply with legal process, or assist law enforcement.

Nothing in this policy creates a duty to install cameras, monitor cameras in real time, preserve every recording, or release footage when disclosure would violate law, security, or another person's privacy.

5. Retention and security

The normal retention period for recordings is still being confirmed with Mike. Once confirmed, recordings will be retained for that period unless additional retention is reasonably necessary for an incident, investigation, insurance matter, legal hold, dispute, or legal obligation — preserved footage will be deleted or overwritten when it's no longer reasonably needed, subject to applicable law. Q Fitness uses reasonable measures designed to protect recordings against unauthorized access, alteration, and disclosure.

Part III — General Facility Policies

These policies supplement the applicable membership agreement, waiver, posted rules, and staff instructions. If they conflict, the membership agreement controls unless applicable law requires otherwise. Q Fitness may take reasonable action to protect safety and operations, including issuing a warning, restricting access, suspending or terminating a membership, or contacting law enforcement.

1. Respectful conduct

Members and guests must behave safely and respectfully. Threats, harassment, discrimination, intimidation, fighting, deliberate property damage, disruptive conduct, and conduct that unreasonably interferes with another person's workout are prohibited.

Members and guests may not provide unauthorized personal-training or commercial services at the facility.

2. Check-in, access credentials, and guests

Members and guests must follow Q Fitness check-in and identity-verification procedures. Your Rhombus access credential is personal and may not be shared. A lost phone or compromised credential must be reported promptly.

Guests may enter only when permitted by the member's plan or Q Fitness staff and must complete any required registration and waiver. Members are responsible for ensuring their guests follow Q Fitness policies. No person may allow an unauthorized individual into the facility.

3. Photography and recording

Photography, video, and audio recording are strictly prohibited in restrooms, changing areas, and any other private area.

Do not record another member, guest, or staff member without that person's permission. Recording must not interfere with workouts, monopolize equipment, create a trip hazard, disclose private information, or be used for unauthorized commercial activity. Q Fitness may direct anyone to stop recording or remove equipment at any time.

4. Alcohol, drugs, smoking, and vaping

Smoking and vaping are prohibited inside the facility. The possession, distribution, or use of illegal drugs and the unauthorized possession or consumption of alcohol are prohibited. Do not use the facility while impaired in a way that creates a safety risk.

5. Weapons

To the extent permitted by applicable law, weapons are prohibited on Q Fitness property. This prohibition applies regardless of whether a person has a license or permit, except for on-duty law-enforcement officers or as otherwise required by law.

6. Lockers and personal property

Lockers are provided for temporary use while you are at the facility unless Q Fitness expressly assigns one for longer use. Use a lock where appropriate and remove your belongings when required. Q Fitness is not responsible for lost, stolen, or damaged personal property except to the extent liability cannot be limited by law.

Property left behind may be handled under Q Fitness's lost-property procedures and, after a reasonable period, may be discarded or donated as permitted by law. Report theft or suspicious activity promptly.

7. Bags and trip hazards

Keep gym bags and personal items out of walkways and away from equipment where they could create a hazard. Store larger items in designated areas or lockers.

8. Clothing and footwear

Wear appropriate athletic clothing and footwear in workout areas. Clothing must provide reasonable coverage and must not present a safety hazard or display threatening, discriminatory, or harassing content. Follow any posted rules for specialized training areas.

9. Equipment and workout safety

Use equipment only for its intended purpose, follow posted instructions, and comply with staff safety directions. Do not use damaged equipment; report it promptly. Re-rack weights and return equipment after use. Do not modify equipment or bring large, hazardous, or unauthorized equipment into the facility.

Avoid monopolizing equipment, and allow others to work in when reasonably practical. Chalk, tripods, specialty equipment, and outside training tools may be restricted where they create excess cleaning, space, or safety concerns.

10. Solicitation and commercial activity

Unauthorized solicitation, sales, distribution of materials, political campaigning, fundraising, and commercial activity are prohibited on Q Fitness property.

11. Nondiscrimination

Q Fitness is committed to providing fitness opportunities without unlawful discrimination. We do not discriminate on any basis protected by applicable law. Members and guests must follow the same standard in their conduct toward others.

Part IV — External Social Media Guidelines

Q Fitness welcomes respectful questions, feedback, and community participation on its social-media pages. Q Fitness may hide, remove, report, or restrict content or accounts that violate platform rules or these guidelines, including content that:

  • reveals personal or identifying information without permission;
  • depicts another member, guest, or staff member without appropriate consent;
  • contains threats, harassment, hate speech, discriminatory content, sexual content, or abusive language;
  • is fraudulent, misleading, defamatory, or unlawfully invasive of privacy;
  • infringes copyright, trademark, publicity, or another person's rights;
  • promotes unauthorized commercial services, spam, scams, or repetitive off-topic messages;
  • encourages unsafe or illegal conduct; or
  • contains malware or suspicious links.

Social-media pages are not appropriate for emergencies, formal legal notices, billing disputes, or privacy requests. Use the contact information in Part I, Section 15 for those matters. If there is an emergency, call 911.
